Dear TFIR Members:

Our program on Saturday, May 11, will be about the recent Texas legislative session, what was accomplished and what we must do. For all those attending there will be copies of the Judicial Watch Special Report and discussion of it. This report is an interview between Tom Fitton, Judicial Watch President, and Arizona Senator Russell Pearce. Learn the depth of Senator Pearce’s understanding of the Constitution and how we can counteract the pressure to remove power from the people. Get your copy and take part in the discussion. There will be coffee and treats before the meeting.

Each month I wonder what I will use for the newsletter. Then usually something just pops up as being very important. This month I dedicate the newsletter to Senator Russell Pearce of Arizona. With his guidance, Arizona has paved the way to return power to the states and show the nation how standing up for one’s country can work. The recent Supreme Court decision vindicates the Arizona law. How many men have had three bills before the Supreme Court in one year? This brave man needs our support. The left is working to have him recalled from his office. There are millions going into the campaign to discredit him.

Pearce’s son, a law enforcement officer, was shot by an illegal alien. Houston experiences another death, that of HPD officer, Kevin Will, who gave his life in saving another fellow officer when an “allegedly” intoxicated illegal alien, Johoan Rodriguez, driving at an estimated 80 miles per hour struck the officer while he was investigating an accident. Winning this issue about stopping the Sanctuary City concept will prevent our law enforcement officers from being killed and also our citizens. It is time to force this issue.

I sat with a woman at the hearing in Austin this month on the Anti- Sanctuary City bill HB 12. She described the vicious murder of her son by an illegal alien. This young man’s death was so terrible, and the aftermath of the cover-up by the perpetrator, that I thought surely it might just affect some of the Committee Members. They seem to be desensitized to the tragedies in our cities. But then I think of this type of legislation going in a straight line for a vote Yea, and am totally unaware of the games being played behind the scenes to use such bills for leverage on other legislation. With the number of deaths by illegal aliens, everyone in this state should be concerned about safety, even if they live in gated subdivisions. Our state senators and representatives should take time to understand the stakes.

Much of what we send on comes from IRCOT. It was formed to play an active roll in Austin and then keep us informed.

Every few years I pick up Sterling Seagrave’s The Soong Dynasty to remind myself of the conspiracies, lies, naïveté, and dishonesty that have occurred in American history. For many years thanks to Henry Luce we were duped into supporting the regime of Generalissimo Chiang Kai-Shek of China and then Taiwan. The converted Chinese Charlie Soong and his brood became the world’s wealthiest family. This history of China during WWII I keep by my bedside to remind myself to be eternally vigilante when the press here makes fun of anyone questioning their expert investigative powers. It is wise to question what the media tells you. Media has ownership that just may have an agenda that you are not aware of. No one had a more powerful press than Henry Luce with the Life and Time publications. Life was the foremost pictorial magazine of the period. Everyone read Time for the latest news. For years the myths of Chiang Kai-Shek dominated and influenced America, and we wasted millions of taxpayer dollars supporting a regime that was run by the very unsavory Chang Kai Shek. Chang was brought to power by a ruthless killer in China, Big Eared Tu. Tu was the most militant anti-Communist leader in China. He was also a criminal mastermind, the boss of the Green Gang. Lest you think there have not been conspiracies in our history, you need only follow the history of China and the United States carefully. With the upcoming election, be on your guard and look beneath the campaign rhetoric for answers. What goes on in the rest of the world doesn’t stay there. It affects our lives everyday here at home.

Supreme Court Upholds E-Verify

The Supreme Court decided 5-to-3 that states can punish employers who violate a mandatory E-Verify law. The court challenge was led by the U.S. Chamber of Congress against Arizona's 2007 law that suspends a business's license if they don't use E-Verify to check the eligibility of all new hires.
During the creation of the Basic Pilot Program, which is now known as E-Verify, Congress gave authority to the states to use its business licensing practices as penalty for companies that hire illegal workers. The Court used that clause in its majority opinion.
Arizona’s procedures simply implement the sanctions that Congress expressly allowed the States to pursue through licensing laws. Given that Congress specifically preserved such authority for the States, it stands to reason that Congress did not intend to prevent the States from using appropriate tools to exercise that authority. . . .
Because we conclude that the State’s licensing provisions fall squarely within the federal statute’s savings clause and that the Arizona regulation does not otherwise conflict with federal law, we hold that the Arizona law is not preempted.
-- Chief Justice Roberts wrote in the majority opinion.
Arizona became the first state in the country to pass a mandatory E-Verify bill that requires all employers to use the employment verification system. Since then, Mississippi and South Carolina have followed suit, while many more states have passed laws requiring some businesses to use E-Verify.
The ruling is a big loss for the nation's major business groups and the Obama Administration who all opposed these types of laws.
Justices Scalia, Kennedy, Alito, and Thomas joined parts of the Chief Justice's opinion. Justice Breyer filed a dissenting opinion joined by Justice Ginsburg. Justice Sotomayor filed a separate dissenting opinion. Justice Kagan removed herself from the case since she filed a brief in support of the U.S. Chamber's argument while working in the Obama Administration's Justice Department.

Creating Facts on the Ground

The Supremes' complete repudiation of the Chamber of Commerce/Obama administration opposition to state E-Verify requirements will likely result in such mandates making more progress in the states' next legislative sessions; Georgia passed a mandate this year, and the Chamber's strategy of scaring lawmakers away from E-Verify with the bogeyman of Arizona's SB1070 won’t work any more.
Of course, the point of the push for such state E-Verify mandates isn't really to get all 50 states to sign on separately, but to move Congress to pass a national E-Verify mandate, something House Judiciary Committee chairman Lamar Smith would very much like to do. The state mandates help this along in two ways: First, they obviously create political momentum. But in a more practical sense, as more states require use of E-Verify — whether for all employers or just state agencies and/or state contractors — a larger and larger share of the nation's hiring will be run through the system, increasingly making it a standard part of the employment process. In other words, the goal is to make E-Verify a fait accompli, so that when Congress finally gets around to passing the national requirement, it will be more of a mopping-up operation than the imposition of an unfamiliar requirement on unsuspecting employers. And I think we're already getting close to that tipping point.
The Magnitude of the E-Verify Win

By the way, an interesting tidbit – the administration not only supported the Chamber, but had Neal Katyal — the Acting SG [Solicitor General, who represents the federal government before the Supreme Court] — argue the case. The SG normally argues only one, maybe two, cases per sitting, and that's reserved for the cases the government sees as the most important/prominent.
The reason the administration and the Chamber of Commerce saw this case as so important is that they want to hold back mandatory E-Verify as their main bargaining chip for what they really want out of a "comprehensive" immigration deal — amnesty for the Obama administration and massive increases in imported captive labor ("guestworkers") for the Chamber. The decision makes it more likely Congress will be able to pass such a mandate on its own, not bundled with any amnesty or guestworker provisions. In other words, it's not just a win for enforcement, but also a setback for amnesty and increased immigration.

Mr. Speaker, while Washington lives on in ignorant bliss regarding immigration, the American border remains wide open for the good, the bad, and the ugly. Often, outlaws that enter our country illegally are criminals with no respect for the law of any nation.
This past Sunday, hours before the crack of dawn, twice-deported illegal Johoan Rodriquez drove through a police barricade and ran over and killed Houston Police Officer Kevin Will while he was working an accident scene.
Rodriguez’s immigration status was far from the only crime he committed that day. Rodriguez, a purported member of the MS-13 gang, was driving three times the legal limit drunk and was charged with driving while intoxicated, possession of cocaine, evading arrest, and manslaughter. The crime was so violent that Officer Will’s body was dragged down the road before the killer stopped and was apprehended.
Deportation is no deterrent to criminals like Rodriguez, because as long as our border remains wide open in both directions, criminals will simply return to the United States and kill Americans. Meanwhile, Officer Will will be buried today.
And that’s just the way it is.

EXCERPTS FROM JUDICAIL WATCH SPECIAL REPORT
Senator Russell Pearce:
Illegal is illegal. Arizona didn’t make “illegal” illegal; it was already illegal. And illegal is not a race. It’s a crime and it must be enforced. It’s against (the) law to break into this country, even if they are otherwise good people. Americans can’t find work, and it’s not okay to let people come in and create what I call job theft. Iti s illegal for them to be employed. It’s illegal for them to have those jobs and take (them) from Americans. And here’s what I can’t understand: apparently, in the minds of some, I’m a bad guy for defending Americans, for defending American workers, for defending the rule of law…
Let me give you a few quick statistics. In parallel with the 100,000 who apparently have left Arizona as the result of the threat of these laws being enforced and the vigilance of (Maricopa county, Arizona) Sheriff Joe Arpaio and others, violent crime is down 26% in many of our cities. Homicides in Phoenix are reportedly down over 50%.
Who in the media is talking about that? Nobody wants to point out the value of safe neighborhoods, safe streets, less homicide.

Answers
1. c. Have a baby in order to have a child with U.S. citizenship and entitlements which include being able to bring family to the United States. The two citizenship benefits that have drawn the most attention in the birthright citizenship debate are, first, food assistance and other welfare benefits to which a family of illegal aliens would not otherwise have access, and second, the ability of the child when he grows up to legalize his parents, and also to bring into the United States his foreign-born spouse and any foreign-born siblings. The sponsored spouse can, in turn, sponsor her own foreign-born parents and siblings, and the siblings can, in turn, sponsor their own foreign-born spouses, and so on, generating a virtually never-ending and always-expanding migration chain. Because having a child on U.S. soil can cement an immigrant’s presence in the United States, provide access to welfare benefits, and ultimately initiate chain migration of the child’s extended family and in-laws, children born to illegal aliens and legal temporary visitors are sometimes referred to as “anchor babies.” These benefits have contributed to the growth of a “birth tourism” industry.
2. c. 300,000 to 400,000. No one knows for sure. This is more than the number for legal immigration for many years which used to average about 250,000 immigrants. This is as many as one out of ten births.

The report estimates that between 2001 and 2009, births to illegal immigrant women totaled 542,152 in Texas alone.
